1. Acceptance of Terms
By using the CutList Opt mobile application (the "App"), you agree to be bound by these Terms of Service. If you do not agree to these Terms of Service, you may not use the App.
2. License
CutList Opt, Inc. ("CutList Opt", "we", "us", or "our") grants you a non-exclusive, non-transferable, revocable license to use the App on a single device.
3. Restrictions
You may not:
Use the App for any commercial purpose.
Modify, reverse engineer, or decompile the App.
Remove or obscure any proprietary notices from the App.
Transfer or sublicense the App to any third party.
Use the App in any way that violates any applicable law or regulation.
4. Termination
We may terminate your license to use the App at any time for any reason.
5. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
6. Limitation of Liability
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws provisions.
8. Entire Agreement
These Terms of Service constitute the entire agreement between you and CutList Opt with respect to the App.
9. Severability
If any provision of these Terms of Service is held to be invalid or unenforceable, such provision shall be struck from these Terms of Service and the remaining provisions shall remain in full force and effect.
10. Waiver
No waiver of any provision of these Terms of Service shall be effective unless in writing and signed by both parties.
